GETTING CUSTODY MINOR CHILD

In many cases of divorce there are certain circumstances that a mother does not have to worry about getting custody minor child. Instances where a parent does not have to worry is when the other parent has not been in the child’s life or made any contact for a year, the parent’s agree on the arrangements, and the parents were never married.

Many times parents are separated prior to a divorce. If parents are separated prior to filing for divorce and the non-custodial parent has made no effort to make contact with the child for visitation purposes, then the courts will consider the parent as abandoning their child. Some courts would approve the child to be adopted. For example, the mother and father have split up and the child lives with the mother. The father has left and no one has heard from him since. If the mother meets another man who is willing to adopt the child as his own, a judge will allow it because the biological father has not been around. Even if the biological father did come back, he may still lose his rights. A stipulation to this would be if the father hadn’t seen the child because the mother played a role in keeping him out of the child’s life. Then the mother would not be getting custody minor child.

If both parents agree to who is getting custody minor child then the courts will make a ruling by the parent’s decision. This is because the courts will trust that the parents have made a decision for what is best with the interest of the child and go with it.

Another circumstance where mothers do not need to worry about who is getting custody minor child is when the mother doesn’t marry the father. This is why it is important not to marry someone because you are pregnant, only to marry if you planned on it in the first place. If a mother has not married the man then she has custody of the child and the child will remain in her care unless she is proven unfit due to drugs during the pregnancy or some other reason. Fathers will have rights, but not custody in most cases.

Getting custody minor child in most cases is not something that mothers have to worry about unless they are proven unfit.
